Terms of Service
Version 2026-08-27 (replaces 2 August 2026). These terms cover everyone who uses Sepal — people browsing Sepal as visitors, and business owners running a stall or store. This version adds visitor terms for the new discovery experience, confirms Sepal does not process payments or orders, and replaces the pre-launch placeholder with Sepal’s real operator details.
1. Acceptance
By creating an account, browsing Sepal, or listing a business on Sepal, you agree to these Terms. If you’re using Sepal on behalf of a business, you’re also agreeing on that business’s behalf, and confirming you’re authorised to do so.
2. Eligibility & accounts
You must be at least 18 years old to create a Sepal account. During onboarding you confirm your birth month and year and explicitly attest that you’re 18 or over; Sepal checks that attestation before your account can be used. You agree to provide accurate information and to keep your profile — including your name, verified phone number and default location — current. Each account belongs to one person; don’t share your login or create an account on someone else’s behalf without their authorisation.
You don’t need an account to browse Sepal as a visitor — see Section 4. An account becomes a business account the moment you start listing a business, which brings in the additional rules in Section 5.
3. Acceptable use
Do not upload unlawful, deceptive, malicious or rights-infringing content; impersonate another person or business; probe, scrape at scale, or attempt to gain unauthorised access to other accounts or non-public parts of Sepal; or use Sepal in a way that unreasonably consumes or disrupts the service. This applies equally to vendors and visitors.
4. Using Sepal as a visitor
Sepal’s discovery pages — browsing vendors, searching by location and radius, viewing a market day, and viewing a business’s public profile — are free and don’t require an account. If you allow location access, Sepal uses your device’s approximate coordinates for that search only, to show nearby vendors and markets; see the Privacy Policy for how that’s handled. Saving a vendor is stored only on your own device and isn’t tied to an account — switching devices starts you with an empty saved list.
Sepal is a discovery platform, not a payment processor or marketplace. Sepal does not process payments, orders or in-app purchases. A product’s price and any purchase link shown on Sepal are supplied by the business and are for information only; if you buy something, that transaction happens directly with the business, away from Sepal, and Sepal is not a party to it and isn’t responsible for it.
5. Using Sepal as a business (vendor)
You must be authorised to represent any business you list, and must keep its ABN, contact details and public listing information current and accurate. Sepal verifies your ABN against the Australian Business Register at setup. You’re responsible for the accuracy of everything you publish — your business story, product listings, prices, images and market day details — including any category Sepal’s AI assistant suggests for your business or products; check suggestions before accepting them, since Sepal is an early-stage service and suggestions can be wrong.
Once a business is published, its verified contact phone number is shown publicly so visitors can call or text it — see the Privacy Policy. Market-day check-in and check-out confirm your attendance at a specific time and place; check-in requires your device’s location to be within about 500 metres of the listed market address, from 30 minutes before the start time through the listed end time. You’re responsible for the accuracy of the address and time you publish for a market day.
6. Content & intellectual property
You retain ownership of everything you upload — business stories, product listings, images and any other content. By uploading it, you permit Sepal to host, process, reproduce and display it as needed to operate the service, including showing it to other users and, where you’ve published a business, to the public. Public business profiles, product listings and images are visible to anyone, including people who aren’t signed in.
7. Communications
Using certain Sepal features means agreeing to receive the messages that feature requires: an SMS one-time code when you verify a phone number, and confirmation or reminder emails tied to your account or business (like a market-day reminder or an email-change confirmation). These are service communications, not marketing, and you can’t opt out of them without stopping use of the feature they support. Sepal does not currently send marketing email; see the Privacy Policy for how that will work if it starts.
8. Suspension, archiving & termination
Sepal may suspend or remove content or listings that breach these Terms. A business can be archived, which starts a 30-day recovery period before its data is more permanently removed. You can delete your account from profile settings, subject to limited backup retention and any legal retention requirements described in the Privacy Policy. You may stop using Sepal at any time.
9. Service changes & disclaimers
Sepal is an early-stage discovery service still being built — features, availability and AI-generated suggestions may change, and Sepal doesn’t guarantee that any listing, market day or product will be accurate, available, or currently trading. Sepal is provided “as is” to the fullest extent the law allows. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that can’t lawfully be excluded; where Sepal’s liability can otherwise be limited, it’s limited to re-supplying the relevant part of the service.
10. Governing law
These Terms are governed by the laws of Queensland, Australia, and each party submits to the non-exclusive jurisdiction of its courts.
11. Changes to these terms
Material changes will be versioned, like this one, and where appropriate, you’ll be asked to accept the new version before continuing to use Sepal.
